284) At this point it is sometimes argued that if we were to ascribe rights to animals we would then have to ‘police’ nature to ensure that other animals do not violate those rights. This clearly would be absurd. But the point is, surely, that if we accept that animals could be given rights despite not being fully rational agents able to engage in a social contract, they would by definition not have duties. Only moral agents can understand and take on duties and be held morally accountable for their actions.

In return, various forms of intervention in the hitherto sovereign affairs of nations would be justified and accepted: the over-exploitation of a country’s natural resources (forests or flora or fauna, for example) would no longer be tolerated and the countries affected would accept this consequence as the outcome of a fair international regime from which they in turn benefit. Elements of such an interpretation of justice can at times be found in the discussion and output of some international agreements, although it is still far from being a central consideration of all parties.

To think of the geese aesthetically in this way is to ascribe them inherent value; to think of the geese merely as a food resource would be to think of them purely instrumentally. A different approach again would be to argue that even if certain things had no aesthetic or inherent value they should still be protected and preserved for their own sake. This would be to assign intrinsic, non-anthropocentric value to the aspect of the environment concerned, be it an individual animal or an ecosystem.
